1. Software License

This software "Wedding Photos AI Offline Gallery" is an offline photo gallery system developed by Ai digitalpixpro (India). By using, activating or purchasing this software, the user agrees to the following terms.

2. License Grant

Licensed Software, Not Ownership Transfer: This software is licensed, not sold. When you purchase a license, you receive a non-exclusive, non-transferable, limited license to use the software. Ownership of the software and all intellectual property rights remain with Ai digitalpixpro (India).

• The user receives a non-exclusive, non-transferable, time-limited license to use the software on a specific device for the duration purchased (usually 12 months)
• The software, source code and all related technology remain the intellectual property of Ai digitalpixpro
• This is a single-device license; additional licenses required for additional devices
• The license is non-transferable and cannot be resold, rented, leased, or shared with others
• No redistribution or sublicensing - You may not redistribute, sublicense, or grant rights to use the software to any third party
• License validity depends on activation - the software requires valid activation to function beyond the trial period

3. Prohibited Uses

The user may not:

• No reverse engineering, cracking, or decompiling - You may not reverse engineer, decompile, disassemble, crack, circumvent license or security measures, or attempt to derive the source code of the software
• No resale, redistribution, or sublicensing - You may not resell, rent, lease, redistribute, or sublicense the software or activation keys. Unauthorized copying or commercial misuse is prohibited.
• Share activation keys or licenses with others
• Modify, copy or create unauthorized derivatives of the software
• Use the software for illegal purposes
• Attempt to circumvent licensing restrictions or security measures
• Remove or alter copyright notices or proprietary markings
• Transfer the license to another person or entity

Violation of these terms may result in immediate license termination and may lead to legal action under Indian law.

4. Licensed Software Nature

• This is licensed software, not a subscription service (SaaS)
• Once activated, the software operates independently without requiring ongoing connection to our servers
• Licensing is required for continued use beyond trial period
• No automatic renewals occur without explicit user consent
• License activation is tied to specific hardware identifiers

5. Offline Processing

• Works offline after the gallery is delivered. Internet is required only to send the gallery file.
• No photos, client data or galleries are uploaded to any server by default
• All processing happens on the user's own computer
• User retains full ownership and control of their data
• Software does not transmit data without explicit user action

6. Performance Disclaimer

Results May Vary: Tool performance may vary based on usage, system configuration, and other factors. No guarantee of specific results or business profit is provided.

Output size, compression, speed and quality depend on:

• Computer hardware specifications
• Photo resolution and file sizes
• Quantity of photos being processed
• Available system resources
• Operating system version and configuration

The portal displays real-time dynamic values based on actual processing. No fixed performance guarantees are claimed. Performance may vary based on system configuration.

7. Activation and Evidence

Every license activation involves:

• Screen recording for activation verification
• Logging of date, time and device information
• Verification with activation keys and hardware fingerprints
• Creation of tamper-evident logs for legal compliance

These records are maintained for legal compliance, security, and patent-related evidentiary purposes.

8. Intellectual Property

All intellectual property rights in the software belong to Ai digitalpixpro. The software is protected under Indian copyright law and is the subject of a pending Indian patent application. Indian Patent Application No. 202521102243 relates to certain innovations in the software. Patent status is subject to examination by the Indian Patent Office.

9. Limitation of Liability

• The software is provided "as is" without warranties of any kind
• We are not liable for any damages resulting from software use
• Users are responsible for backing up their own data
• We are not responsible for computer failures caused by third-party software conflicts
• Total liability is limited to the amount paid for the software license

10. Termination

This license agreement may be terminated:

• If you breach any terms of this agreement
• If you attempt to reverse engineer or circumvent licensing
• If fraud or misuse is detected
• Upon expiration of the license term

Upon termination, you must cease using the software and destroy all copies.

11. Governing Law & Jurisdiction

This agreement is governed by the laws of India, including but not limited to:

• The Information Technology Act, 2000 and its amendments
• The Copyright Act, 1957
• The Indian Patents Act, 1970
• Consumer Protection Act, 2019

Jurisdiction: Any disputes shall be resolved in the courts of Gujarat, India. The software is designed and operated in compliance with Indian law.

12. Patent Status Disclaimer

WPS AI Gallery uses patent-pending technology covered by Indian Patent Application No. 202521102243.

• Patent Status: Indian Patent Application Filed (Patent Pending)
• Examination Status: Patent status is subject to examination by the Indian Patent Office
• No Guarantee of Grant: We do not guarantee that the patent will be granted

The patent application is pending examination. The final outcome depends on the Indian Patent Office's review process.

13. Changes to Terms; Service Modifications

We reserve the right to modify these terms at any time. Continued use of the software after changes constitutes acceptance of the new terms. Significant changes will be communicated to users where practicable.

We reserve the right to update, suspend, or modify the software or related services (including activation or portal access) for operational, security, or legal reasons. We will not be liable for any suspension or modification where reasonably applied.

14. No Absolute Guarantees

This software is a tool. We do not guarantee uninterrupted, error-free, or fault-free operation. Performance and results depend on your device, usage, and environment. No lifetime guarantees or absolute security claims are made.

By using this software, you acknowledge that you have read, understood and agreed to these Terms of Service.
